Please carefully read the following terms and conditions relating to your participation in any of Lex Levinrad’s events or seminars which are conducted by The Distressed Real Estate Institute, LLC (“Promoter”). These terms and conditions are relevant to all Lex Levinrad and Distressed Real Estate Institute Events, Meetings, Seminars, Boot Camps, Coaching, Group Mentoring Programs, Workshops and Seminars including but not limited to Distressed Real Estate Boot Camp, Partnership Program, Private Coaching, Group Coaching, Group Mentoring, Private Mentoring, Fixing and Flipping Boot Camp, Real Estate Internet Marketing Boot Camp, Distressed Real Estate Bus Trip, Distressed Real Estate University, Lex Levinrad Real Estate Mastermind, Platinum Inner Circle Events, Inner Circle Masterminds. For the purposes of this site, and since registrants may register for only one event at a time, all events and seminars will be referred to from here forward in the singular tense as simply the “Seminar.”

By registering for our program and signing up for the Partnership Program, Distressed Real Estate Boot Camp, Fixing and Flipping Houses Boot Camp or any other live training or online training or any event being held at any of our locations (“Hotel”), you (the “Attendee”) signify your acceptance of and obligation to these terms and conditions. If you have objections to the following Terms and Conditions, you should not register for the Partnership Program or attend any of our seminars, workshops, boot camps, group mentoring, Inner Circle or any other training events (collectively the Seminar).

Attendee Conduct:

Promoter requires all Attendees to be respectful and professional to our staff, location hosts, speakers, and other attendees and their guests or families throughout the Seminar, even during non-scheduled downtime and breaks. Promoter reserves the right to ask Attendee and/or their guests to leave the conference room and Hotel immediately should they be deemed rude, uncooperative, unprofessional, intoxicated or in possession of alcohol or any illegal substance. In such case, the Attendee’s tuition/fees for the Seminar will not be reimbursed under any circumstances and they will not receive any future products, services or correspondence from Promoter. Attendee will also not receive any of our advertised bonuses or qualify for our satisfaction guarantee or any other written or implied guarantee.

Liability Waiver

While we take every possible measure to ensure Attendee safety at the Seminar, we cannot control everything. For this reason, Attendee is legally responsible for their safety and behavior and agrees to, and is held legally liable to, the following statements:

I, the willing Attendee of the Seminar, hereby accept all risk to my health and of my injury or death that may result from participating in the Seminar and I hereby release Promoter, Lex Levinrad, The Distressed Real Estate Institute LLC, and their officers, agents, employees, interns, contractors, sponsors and representatives from any and all liability to me, my personal representatives, estate, heirs, next of kin, and assigns for any and all claims and causes of action for loss of or damage to my property and for any and all illness or injury to my person, including my death, that may result from or occur during my participation at the Seminar, whether caused by negligence of the Promoter, its governing board, officers, employees, or representatives, or otherwise. I further agree to indemnify and hold harmless Promoter, Lex Levinrad, The Distressed Real Estate Institute LLC and any third-party company from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while attending and participating in the Seminar. Under no circumstances will Promoter or Lex Levinrad, The Distressed Real Estate Institute or their assigns be held liability for my injury or death or any loss or damage of my personal belongings resulting from my participation in the Seminar. Should I require emergency medical treatment as a result of accident or illness arising during my attendance and participation in the Seminar, I consent to such treatment. I acknowledge and I agree to be financially responsible for any medical or legal bills that may be incurred as a result of emergency medical treatment. I will notify Promoter verbally and in writing if I am at any time injured prior to, during, or after the Seminar in my travels or attendance, or if I have medical conditions about which emergency medical personnel should be informed; however, I understand that Promoter is not legally obligated to act on that information in any way or to providing any medical service whatsoever to me. I agree that if I have any medical or psychological conditions that may hamper me from fully and healthfully participating in the Seminar that I will notify the Promoter and that the Promoter retains the right to ask that I not participate in portions of or the entirety of the Seminar.

Liability Disclaimer: No Professional Advice

The information contained in or made available by the Promoter, Lex Levinrad, The Distressed Real Estate Institute or any third-party through the Seminar or their websites or services cannot replace or substitute for the services of trained professionals in any field, including, but not limited to, accounting, mental, financial, medical, psychological, or legal fields. Promoter does not offer any professional personal, accounting, medical, financial or legal advice and none of the information contained in the Seminar should be confused as such advice. Neither Promoter, Lex Levinrad, The Distressed Real Estate Institute nor their assigns, sponsors, speakers, partners, contractors, employees, interns, representatives or any of their affiliates will be liable for any direct, indirect, consequential, special, exemplary or other damages to the Attendee or the Attendee’s business, including economic loss, that may result from participation in the Seminar or from the use of, or the inability to use, the materials, information, or strategies communicated through the Seminar or any products or services provided pursuant to the Seminar, even if advised of the possibility of such damages. Under no circumstances, including but not limited to negligence, will Promoter or Lex Levinrad or the Distressed Real Estate Institute be liable for any special or consequential damages that result from Attendee’s participation in the Seminar. To be clear: You, the Attendee, alone are responsible and accountable for your decisions, actions and results in life, and by your participation in our Seminar, you agree not to attempt to hold us, the Promoter Lex Levinrad, or the Distressed Real Estate Institute LLC liable for any decisions, actions or results that you make or experience in business or in life due to your participation in this Seminar at any time, under any circumstance.

Confidentiality and Non-Compete

Attendee hereby understands that the tools, processes, strategies, materials and information presented in the Seminar are confidential, copyrighted, and proprietary to the Promoter and agrees not to record, duplicate, distribute, summarize, teach or train from the Seminar materials in any manner whatsoever without the express written permission of Promoter. Any unauthorized use or distribution of these proprietary concepts, materials, and intellectual property by you or your representatives is prohibited and Promoter will pursue legal action and full damages if these terms are violated in order to protect its rights.

Youth Policy

Children under the age of 18 are not permitted to attend, and persons between 18-21 years old must be accompanied by a parent or guardian throughout the entire event.

Force Majeure, Acts of God and Unpredictable Events

In the event of any force majeure, act of god, natural disaster or unpredictable or unforeseen event such as a hurricane, tornado, earthquake, riots, power outages, war, terrorism, explosions, water or sewage outages or any other unforeseen event not specifically listed, we will not be held responsible for this unpredictable event under any circumstances. In the event that a boot camp, inner circle or training event is cancelled due to unforeseen or unpredictable events such as a hurricane, tornado, earthquake, riots, power outages, war, terrorism, explosions, water or sewage outages we will not issue a refund for the cost of your ticket to attend the event nor will we reimburse you under any circumstances for plane tickets, travel costs, hotel stays or any expenses related to attending the event. We strongly advice and encourage you to purchase travel insurance if you are flying in or booking hotels for the event. In the event of a boot camp or training event cancellation we will give you a 2 years credit to attend another boot camp or similar training with no additional fee. In the event that the hotel hosting the event is out of power or closed due to an act of nature such as a hurricane, tornado, water, sewer or power outage then our best efforts will be utilized to try and locate an alternative location to host the boot camp or training event. However if no alternative location is available then the event will be rescheduled to a future date and all registered students will receive an email notification of the change of date of the event. We will not be held liable under any circumstances for your cost of hotel, travel, plane tickets or any travel expenses under any circumstances due to situations that are not within our control. We strongly encourage all attendees to purchase travel insurance that will provide for trip interruption, cancellation fees etc. We will not issue a refund under any circumstances if a boot camp or training event is cancelled but we will give you a 2 year credit to attend a similar event in the future without any charge to you.

Adult Language/Content

During our Seminar, we will discuss several adult topics relating to personal, financial and professional growth. We will also occasionally use adult or profane language to emphasize a point or connect with or surprise the audience (though we will never be lewd, and we will always use tact and discretion in doing so). Participants who are uncomfortable with such topics or language should not attend the Seminar.

Audio/Visual Rules and Release

Attendees may not, under any circumstance, use any type of recording devices video, or audio or otherwise to capture the information provided at the Seminar. No recording devices, photography or videography is allowed in the Seminar room.

By participating in the Seminar, Attendee understands that portions of the Seminar’s live events may be recorded in video and audio and/or captured in still and/or digital photographs by the Promoter. Attendee agrees that the Promoter and its assigns have the right and permission to use such recordings and photographs should they include Attendee’s name, likeness, voice, biographical details, testimonial, or photograph for marketing, advertising or any other purpose in any media or format, online and/or offline, now or hereafter without further compensation, permission, or notification to the Attendee. Attendee understands and agrees that all recordings from the Promoter’s events are the exclusive rights of the Promoter and Attendee does not ask for or expect compensation for the use of recordings or photographs in which Attendee appears or speaks. Promoter owns all rights of any audio, video, and/or photograph captured during the Promoter’s Seminar or at any of the Promoter’s other live events.

Privacy Policy and Terms of Use

By visiting our event sites and participating in the Seminar, Attendees acknowledge and agree that they are subject to the Privacy Policies and Terms of Use of the promoter, which are listed at:

Cancellation Policy

Once Attendee registers for our Partnership Program or any of our Boot Camps (the Seminar), we make extensive arrangements and investments while anticipating their tuition and attendance, and, in the case of their cancellation, we incur significant administration hassles, expenses, and loss of business. Given this fact, we do not accept cancellations or issue refunds after an attendee has registered for the Partnership Program or for the Distressed Real Estate Boot Camp or Fixing and Flipping Houses Boot Camp or any other event collectively referred to as “Seminar”. There will be NO REFUNDS issued at all for any reason under any circumstances and there are no exceptions to this policy. Please do your due diligence about our program before registering for our program since once  you register for the Partnership Program we will NOT issue ANY REFUNDS. If you have signed up for the Partnership Program and you are paying the monthly membership fee to be in our program and you would no longer like to remain in the program then you can cancel your monthly $97 membership fee at any time for any reason. However if you cancel your Monthly Membership fee then please keep in mind that access to the Lex Real Estate Training Site, Proof of Funds Letter Site, Support Desk, Email Support, All Boot Camps, Coaching Calls, and Webinars will be revoked on the date that you cancel. If you paid the annual plan which includes 12 months of the membership fee in order to save money then we will NOT refund you the price that you paid to sign up for our program. Please keep this in mind when choosing which plan to sign up for. In the event that you cancel your monthly membership fee then if you want to sign up in the future  you will have to pay the prevailing rate (which may be much higher) and sign up again as a new student. This is due to the extremely limited seating for our boot camps and training events and the fact that access to our Partnership Program gives you instant access to our complete system (and support).  Every sale that is made counts towards a seat being reserved at both of our boot camps for you (which means we turn away other sales). Since our boot camps have been oversubscribed and sold out for 8 years we actually do lose sales by holding a seat for you at both of our boot camps.  We turn away new students when our boot camps are full and because of this we cannot offer refunds after you sign up for our Partnership Program at any time and without exception. If you are unsure of whether or not this is the right training program for you, then do not register until you are sure that it is. If you are on the fence then do not sign up. Our program is intended for students that are serious and plan on learning our material and then acting on it. If you are unsure if that is for you then do some more research before deciding to sign up. We feel that the small access fee to our program and the small monthly fee of $97 per month is a very minimal fee for our students to have access to our boot camps, training site, proof of funds letter and Support Desk. If for whatever reason you are unable to attend the live training boot camp you are always able to watch the video of the training event on our training site and as long as you are paying the monthly membership fee of $97 you can attend any boot camp in the future. Our training program is designed for all of the materials to complement each other. The Home Study Course, Lex Real Estate Training Site, the Fix and Flip Boot Camp and the Distressed Wholesaling Boot Camps complement each other and you will achieve maximum benefit by referencing all of the training materials (including attending our boot camps live if you are physically and financially able to do so). If you cannot attend the boot camp in person then we highly recommend that you watch the Boot Camp Videos on our training site from the comfort of your home. If you cannot attend the next scheduled boot camp because of a travel or schedule conflict then you can attend any other boot camp in the future. As long as you are paying your monthly membership fee of $97 you are eligible to attend future boot camps at any time and as many times as you want.

Note: The reason we have a no refunds and cancellation policy that like this is because each Boot Camp sells out and is oversold and when an attendee cancels we have to manage the administration challenges as well as prepare additional marketing efforts to fill that space. That’s why we do not issue refunds.  It really does cost us substantial time and resources to process and refund a payment, to refund the promoter or affiliate from which the Attendee signed up, and to communicate all this to Lex Levinrad and the Distressed Real Estate Institute employees and staff and the Attendee and the promoter and the event planner for the Seminar, and to prepare marketing to fill seats, which includes banner ads, creating emails, mailings, online ads, postcards, telephone confirmations etc. Given the number of our Attendees and the sold out nature of our boot camps it’s important for us to maintain this policy. This is our only method to ensure that serious participants signup and that we do not lose business on empty seats.

Earnings Disclaimer

We’ve taken every effort to ensure we accurately represent our Seminar and it’s potential to help you invest in real estate. However, there is no guarantee that you will earn any money using the techniques you learn at the Seminar, and we do not purport this as a “get rich scheme.” Nothing on our websites or at our Seminar is a promise or guarantee of earnings. Your level of success in attaining similar results discussed is dependent upon a number of factors including your skill, knowledge, luck, ability, dedication, business savvy, network, and financial situation. Because these factors differ according to individuals, we cannot guarantee your success, income level, or ability to earn revenue. Disputes and Jurisdiction

These Terms will be governed by and construed in accordance with the laws of the State of Florida. Attendee agrees that any dispute that arises out of or relates to these Terms will be resolved via non-binding mediation in the State of Florida via a professional mediator obtained by the Promoter and if a successful mediation is not reached, to binding arbitration arbitrated in the State of Florida and in accordance with the policies set forth by the American Arbitration Association. If any of these Terms of use are found unlawful, void, or for any reason unenforceable, then that provision will be considered severable from the remaining terms of use, and will not affect the validity and enforceability of the remaining provisions.

These Terms are subject to change at any time without prior notice and at the sole discretion of the Promoter. Please visit this site regularly for updates to these terms. When the terms are changed you will be bound to the new terms and these terms are constantly updated so please check back regularly.
